In the present case, it will need to be examined whether the font, colours, and rectangular background can be perceived as an indication of commercial origin. It is for the examiner to ascertain if the mark applied for, considered as a whole, enables the relevant public to memorise it easily and instantly as a distinctive mark for the goods and services to which an objection has been raised. In that regard, it must be assessed whether the sign in question is capable of performing the essential function of a trademark and whether it enables the consumer who bought these goods or services to repeat the experience, if it proves to be positive, or to avoid it, if it proves to be negative, on the occasion of a subsequent acquisition.

商標を構成する一つしかない語について、本来的な識別力を評価した後、審査官は、被異議商標の図形要素が、「Hawaiian」の語に識別力を吹き込み得るか考慮する必要がある。本件の場合、書体、色彩、および長方形の背景が、営業の出所表示として認識され得るかを審査する必要がある。審査官は、関連需要者が、異議申立て対象の商品・役務の識別標識として、出願商標全体を容易且つ即座に記憶し得るか確認すべきである。その点において、本件商標が商標の本質的機能を果たし得るか、また、購入した商品や役務が良かった場合、需要者が本件商標を手掛かりに次回も購入でき、一方、良くなかった場合にはそれを頼りに回避できるか評価しなければならない。
