In the present case, the Board finds that despite a certain degree of stylisation, the figurative elements, namely the font, colours and rectangular background, are not sufficient to endow the trade mark applied for as a whole with any distinctive character, to distract the relevant public’s perception from the non-distinctive meaning of the verbal elements, or to create a lasting impression of the trade mark. These elements do not possess any feature, as regards the way in which they are combined, that would allow the trade mark to fulfil its essential function in relation to the objectionable goods and services designated by the contested application.

本件の場合、ある程度図案化されているとはいえ、書体、色、長方形の背景といった図形要素は、本件商標が全体として識別力を発揮し、関連公衆の認識を識別力を欠く文字要素の意味合いから別のものに逸らし、また、本件商標に対する持続的な印象を形成するには不十分と判断する。当該要素は、その組み合わせ態様からして、被異議対象の指定商品及び役務との関係において、本件商標がその本質的な機能を果たし得るような特徴を備えていない。
