It has long been held that the mere fact that two different items can be found in a supermarket, department store, drugstore or mass merchandiser store is not a sufficient basis for a finding that the goods are related. So too here, in the context of large online and brick-and mortar retailers offering a wide variety of products bearing the brands of others. This evidence is relevant to channels of trade, but it fails to show that Applicant’s and Registrant’s goods are similar or related in the sense that matters for likelihood of confusion purposes, i.e., we cannot find on this record that consumers would believe the goods emanate from the same source.

単に、スーパーマーケット、百貨店、ドラッグストアや量販店において、２つの異なる商品が陳列されているという事実は、従来より、両商品の関連性を肯定する十分な根拠とはなり得ないとされてきた。大規模小売業者が、オンラインや実店舗において、他社のブランドが付された多種多様な商品を販売している状況下、本件においても同様である。これは、取引経路に関する証拠であって、出所混同のおそれに関する問題という意味において、出願人の商品と引用商標の商品とが類似又は関連することを示すには至らない。すなわち、本件において提出された記録物からは、需要者が両商品の出所を同一と理解するとは断定できない。

昔と違い、インターネットを活用したネット取引が発達し、また、八百屋や酒屋、本屋といった専門店から量販店主流に変わった現在において、『商品の売場が同じ』であることをもって商品の関連性が認められるのであれば、相当数の商品同士が関連することになってしまいます。今後、販売店の共通は、特に、その販売店が大型量販店であれば、商品の類否や出所混同のおそれの判断において、その重要性は下がっていくものと思われます。
