The contested sign is a figurative mark, more particularly a stylised numeral mark that consists of a bold, stylised numeral ‘4’ centred inside a double-lined circular border.
The numeral 4 is used in the European Union as a reference to identify the size of an article of clothing or shoes, inter alia by reference to measures used in US women’s shoe size 4 and clothing size 4, either to indicate the size to customers in the EU that wish to know the size under the US measuring system or to indicate the size, when the goods are for export into the US.
Moreover, it is often used in children’s clothing as a reference to the age. People in the European Union live, work, and study across countries and are exposed to a vast majority of clothing brands from the US. Therefore, many Europeans can identify the respective size indicator instantly.

対訳需要者は、数字の「４」を、サイズのような、商品の特性に係る定量的な尺度と連想する
本願は図形商標であり、具体的には、二重線の円枠の真ん中に配置され、太字で図案化された「4」の数字からなる、図案化された数字標である。
数字の「4」は、EU域内において、衣類や靴のサイズを表す指標として使用されている。とりわけ、米国の女性用靴サイズ4や衣類サイズ4の寸法表示、または、米国の寸法表示に基づくサイズを知りたいEUの需要者にそのサイズを示すため、若しくは、米国への輸出向け商品のサイズを表すために用いられる。
さらに、子供服では年齢の目安としてよく使用されている。欧州連合の人々は国境を越えて生活し、働き、学習しており、大多数が米国の衣料品ブランドに触れている。そのため、多くのヨーロッパ人は、それぞれのサイズ表示を一目で認識することができる。
今日のポイントstylised numeral mark
「numeral mark」は直訳すると「数字商標」。数字自体は、商品の型番やサイズ、等級、品質等を表す場合に使われることから、商標としての識別力を発揮し難いというのは、その通りです。リーバイスのジーンズ「５０１」、ポルシェのスポーツカー「９１１」程の認知度を獲得した数字については、使用による特別顕著性により、例外的に商標登録が認められます。本件は、図案化された数字(stylized numeral)でしたが、EUIPOは自他識別力を認めませんでした。日本では、図案化の特徴において、商標登録が認められる可能性の方が高いように思われます。
