商標の類否や識別力の評価において、需要者の注意力も判断材料の一つですが、注意力が高いほど、購入時に慎重且つ用心深くなり、商品の出所（誰が製造・提供するものか）についてもしっかりと確認するため、出所の誤認混同が起こりにくくなると解されています。そうなりますと、高価な商品を買うときには、通常、誰しも時間をかけて慎重になることから、需要者の注意力が高いことを理由に商標権侵害が成立しにくくなってしまいます。本件は商標の識別力が問題となった事案ですが、ＥＵＩＰＯの指摘は、的を得たものと言えます。
