Considering that the contested sign ‘properti’ and the English noun ‘property’ are pronounced (almost) identically, at least by the non-native English speaking public, the Board is convinced that the neologism ‘properti’ will be perceived by an at least non-negligible part of the English-speaking public in the EU as a misspelling or a deliberate deformation of the English word ‘property’ rather than as a normal, separate English word. This is because ‘property’ is a common and well-established English term, while ‘properti’ does not exist as a correct English spelling and differs only in the replacement of the final letter ‘y’ by ‘i’. Consequently, the misspelling is not sufficient to divert the public’s attention from the clearly perceivable reference to the English noun ‘property’.

少なくとも英語を母語としない一般公衆にとって、本件商標「properti」と英語の名詞「property」の発音が（ほぼ）同一であることを考慮すると、 少なくとも、無視できない数のEU域内の英語圏の公衆は、造語「properti」を、普通に別個の英単語としてではなく、英単語「property」のスペルミス又は意図的に変形させたものと認識する、と当審は考える。これはすなわち、「property」が馴染み深く、よく使われる英単語であるのに対し、「properti」が正しい英語の綴りではなく、語尾の文字「y」が「i」に置き換わっただけの差異に過ぎないからである。したがって、当該差異は、英語の名詞「property」との明らかな関連性から、公衆の関心をそらすには不十分である。

本件が日本で争われた場合、「properti」が「property」と同等と判断されるか？異なる判断になりそうな気がします。単に語尾の文字を置き換えただけと捉えるか、一文字でも語尾が異なれば同じ語とは言えないと捉えるか。アルファベットのみを用いる欧州の言語文化が影響しているように感じました。
