There is no record support for finding that MIFFLIN is an abbreviated form of DUNDER MIFFLIN or that DUNDER MIFFLIN is a humorous reference to MIFFLIN. We find that the fanciful prefatory term DUNDER alters the overall commercial impression created by the term MIFFLIN alone.

本件のように、先行商標「A」と後願商標「B+A」との類否が議論になる事案は少なくありません。「A」の語が、既存語（ディクショナリーワード）であれば、「B」の有無の差異によって商標非類似というのは、ある程度納得できます。「MIFFLIN」は、アメリカの歴史的な人物や地名に関する語のようですので、それであれば、「DUNDER MIFFLIN」と「MIFFLIN」は非類似との判断は妥当かと思います。
