The MAYA and MAYELA marks are not identical, as MAYELA has the additional letters “EL” after the “MAY” and before the “A.” The shared letter string M-A-Y at the beginning of the marks and letter A at the end of the marks lend similarities both visually and phonetically. In both MAYA and MAYELA the “A” and “ELA” sounds are likely to be perceived as trailing softly from the “MAY-” portion and do little to distinguish the marks visually or phonetically. We must consider marks in their entireties and in light of the fallibility of memory. When we do that, we find that MAYA and MAYELA are similar in appearance and sound despite the additional letters “EL” in Applicant’s mark.

ワインにおける「MAYELA」の使用は、商標「MAYA」と混同を生ずるか？
商標「MAYA」と商標「MAYELA」は、同一ではない。「MAYELA」には、「MAY」の後、「A」の前に「EL」の文字が付加されている。両商標に共通する語頭の文字列「MAY」と語尾の文字「A」が、外観類似及び称呼類似に寄与している。「MAYA」、「MAYELA」とも、「A」と「ELA」の音は、「MAY」の文字部分の音から柔らかく流れ出るように認識され、両商標の外観または称呼を区別する役割を殆ど果たしていない。両商標の全体を対比し、また、記憶の曖昧さも考慮する必要がある。そうすると、出願人商標に「EL」の文字が付加されているにもかかわらず、「MAYA」と「MAYELA」は、外観及び称呼上、類似している。

文字商標の類否を検討する場合、最初の文字や音の差異の有無は、確かに重視されますが、本件のように、４文字又は６文字程度の文字構成で、中間の２文字が異なるにもかかわらず、外観類似というのは、日本の商標実務家には理解し難い判断といえます。有名商標が絡む事案でないとすれば、「MAYA」と「MAYELA」の語源的なものが影響しているように思われ、そうなりますと、各国の文化や言語、法制度に精通した商標専門家のアドバイスを得ることが無難といえます。
