Taking account of the specialist nature of all but one of the sources for the news articles and the relative simplicity of the design of the logos, I find that the opponent has not established a prima facie case that the holder had access to the protected work and copied it.

「prima facie case」というのは、英米法（コモンロー）において出てくる用語で、相手方から反証がなければ、その事実や主張が正しいと認定するのに十分な証拠が揃っている状態を指します。裁判等で訴えを認めてもらうための最低限の立証責任を果たしたか否かの指標と言えます。英米では、原告がprima facie evidenceを提示できなければ、被告の反論なくとも、訴えは棄却されます。
