This considerably lessens the similarity arising from that sequence of letters in common, even though the relative importance of that prefix must be taken into account when comparing the signs. By contrast, the differences residing in the suffixes ‘-O’ and ‘-eos’ placed at the end of the signs, together with their differing stylisation, albeit not being particularly distinctive, as well as the distinctive co-dominant figurative device of the contested sign, contribute to creating an overall different visual impression of those signs.

対比する両商標の共通要素「SKIN」/「skin」は、語頭に位置するものの、その記述性により、識別力を欠くか、有るとしても、極めて弱い。両商標の対比において、接頭辞の相対的な重要性は考慮すべきとしても、文字列の共通性に起因する類似性は、これによって著しく低減される。これに対し、両商標の語尾に配置された接尾辞「O」と「eos」における差異は、（特段、識別力があるわけではないが）異なる図案化、及び、被異議商標構成中の識別力を有する、もう一つの要部である図形要素と相まって、両商標全体の外観から生じる印象を異なるものにしている。

文字商標の類否において、構成文字の前半が同じで、共通する文字列も同じ場合、確かに、似ているように思います。ですが、その共通する文字部分の識別力が弱い場合でも商標類似と判断されるのでしょうか？本件では、化粧品との関係で「SKIN」の語が、商品の用途表示に該当すること、スキンケア商品の名称として、「SKIN」の語の後に別の語を配したものが多数取引されていることを考慮した上で、文字商標の類否において前半の文字部分が重視されるとしても、商標非類似と判断されました。
