Visually the signs coincide in the verbal element ‘WENDY’S’, which is clearly legible in both signs. As to the stylisation of the verbal element in the contested mark – which does not alter in any way the identification of the element this is, from a trade mark point of view, banal and does not have any impact on the comparison between the verbal elements at hand. Furthermore, insofar as only the first letter of the verbal element is in uppercase whereas the earlier mark is entirely in uppercase, this does not constitute an irregular capitalisation and is therefore irrelevant for the purpose of the proceedings at stake.

外観上、両商標は、「WENDY’S」の文字要素が一致しており、いずれも、明瞭に判読できる。被異議商標における文字要素の図案化によって、決して文字自体が変わるものでなく、商標の観点からすれば平凡であり、当該文字同士の比較に影響を及ぼすものではない。さらに、文字要素の頭文字のみが大文字で、先行商標は全てが大文字である点については、不規則な大文字表記には該当せず、したがって、本件審理において重要ではない。

文字を図案化し、ロゴデザインにして使用するのは、ブランド実務上、極めて一般的に行われています。それにより問題が生じることは滅多にありませんが、需要者が容易に文字と判読(legible)出来ない程度までデザイン化され、文字の域を超えてしまいますと、類似性の範囲が狭くなったり、不使用取消のリスクが生じます。
