Concerning the figurative element of the contested sign, which is placed above the verbal element ‘OLIMPRO’, the Opposition Division found that this element consists of an abstract figurative device that does not convey any immediate concept and which will be perceived by the relevant public as a merely decorative element.
This is certainly true for some of the relevant public, however, it is also true to say that the figurative element does indeed appear to be a cup flanked by a two halves of a stylised symmetrical wreath, and is likely to be so perceived by a significant part of the relevant public. Either way, it will be seen as decorative and not descriptive of the goods or services at hand and accordingly it possesses some minimal degree of distinctiveness.

「OLIMPRO」の文字の上に配置されている被異議商標の図形部分について、異議審判部は、当該抽象的な図形からは、何らかの意味合いが直ちに生じるものではなく、そのため、関連公衆は、単なる装飾的な要素としか認識しないと判断した。
一部の関連公衆にとっては、事実その通りといえるものの、当該図形部分は、図案化された左右対称の花輪２つをさらに半分にした図形に挟まれたカップのように見受けられ、相当部分の関連公衆は、そのように認識する可能性が高い。いずれにせよ、被異議商標に係る指定商品・役務との関係において、記述的なものではなく、装飾と捉えられることから、最低限の識別性を有している。

「図形」を表す英語としては、「figurative element」、「figurative device」、「graphic device」、「device」、等が使われます。図形は、商標の構成要素ではありますが、図形にも、一見、商標らしい構成のものもあれば、模様（パターン）や装飾（デコレーション）といったものも広く含まれます。装飾であれば、商標を構成しないと一概に判断されるものではなく、実際の使用態様や他の商標との関係において、需要者目線で、出所標識と認識されるか否かで判断されます。日本では、審決や判決において、最低限の識別力（minimal degree of distinctiveness）という概念・捉え方は、あまり目にしません。
