A two–stage analysis is adopted in determining whether registration should be allowed on honest concurrent use :-
(1) whether there has been an honest concurrent use of the mark applied for and the earlier mark;
(2) if the answer to (1) is in the affirmative, whether after considering all relevant circumstances, including public interest, the discretion should be exercised to accept the application for registration of the mark, despite the fact that the use of the mark in relation to the goods or services in question is likely to cause confusion on the part of the public.

善意の同時使用
「善意の同時使用」に基づいて、登録を認めるか否かを判断する場合、以下の2段階で分析する：
(1) 出願商標、先行商標ともに、善意に同時使用されているか；
(2) (1)の条件を満たす場合、関連するすべての事情（公共の利益を含む）を考慮した上で、実際に出願商標が指定商品又は指定役務に使用された場合、一般公衆に混同を生じさせるおそれがあるとしても、当該商標の登録を裁量により判断する。
there has been an honest concurrent use of the mark applied for and the earlier mark
「honest concurrent use」は、日本語では、「善意の同時使用」「善意の併存使用」、「誠実な同時使用」とも呼ばれていますが、日本の商標法に、同様の規定はありません。英国法の影響を受けた国では、「善意の同時使用」により、例外的に商標登録が認められたり、また、商標権者からの権利行使に対する抗弁を主張する際に使われます。
