The stronger that earlier mark’s distinctive character and reputation are, the easier it will be to accept that detriment has been caused to it. The more immediately and strongly the mark is brought to mind by the sign, the greater the likelihood that the current or future use of the sign is taking, or will take, unfair advantage of the distinctive character or the repute of the earlier mark or is, or will be, detrimental to them.

先行商標の識別力及び名声が強ければ強いほど、当該商標に対する不利益が認められやすくなる。被異議商標から先行商標が、速やかに且つ強く想起されるほど、被異議商標の現在又は将来における使用が、ますます、先行商標の識別力又は名声を不当に利用し、又は、それらに不利益を及ぼす可能性が高くなる。

商標の識別力と有名性が強ければ強いほど、たとえ、出所混同のおそれがなくとも、当該商標に化体した信用が有する経済的価値が毀損される「不利益」（detrimental）が生じ得るとして、そのような商標の登録を取消すEUTMルールは、有名商標の保護の在り方という意味で、大変参考になります。日本の商標法は、商標の類否と出所混同のおそれを重視する傾向が強いように思います。
