The Court has set out the essential principle that evaluating likelihood of confusion implies some interdependence between the relevant factors and, in particular, between the previously established findings on the degree of similarity between the marks and that between the goods or services. Therefore, a lesser degree of similarity between goods and services may be offset by a greater degree of similarity between the marks and vice versa. This principle of interdependence is crucial to the analysis of likelihood of confusion.
The interdependence of those factors is expressly referred to in recital 8 in the Preamble to the EUTMR, according to which the concept of similarity is to be interpreted in relation to the likelihood of confusion, the assessment of which depends on numerous elements and, in particular, on the recognition of the mark on the market, the association that can be made with the used or registered sign, the degree of similarity between the mark and the sign and that between the goods or services identified.

相互依存の原則 － １
裁判所は、出所混同のおそれの評価における基本的な考え方として、その判断指標同士、特に、両商標及び指定商品・役務の類似性の程度に関する既定の判断の間に、一定の相互依存関係が認められることを明らかにした。
したがって、指定商品・役務の類似性の程度が低い場合でも、両商標の類似性の程度が高ければ、それと相殺され、逆もまた然り。この相互依存の原則は、出所混同のおそれの分析において、極めて重要である。
これら判断指標の相互依存は、EU商標規則（EUTMR）の前文8に明示されており、これによれば、類似性の概念は、出所混同のおそれとの関係で解釈されるべきであり、多数の要素、特に、市場における商標の認知度、使用中または登録された商標と関連付けられる可能性、商標及び指定商品・役務の類似性の程度に基づいて分析される。

出所混同のおそれの有無が争われる事案において、この判断・認定は、非常によく見かける表現です。日本では、商標の類似性の程度の低ければ、商品・役務の類似性の程度が高くても、需要者が誤認することはなく、このため、出所混同のおそれもないと判断される傾向が高いように、個人的には感じています。最後に出てくる「vice versa」（逆もまた然り）も、よく使われる表現ですので、覚えておくと一目置かれます。
