For a consumer previously exposed to the registrant’s BLACK SWAN word mark alone on wine, a mark with those very words, set forth below a drawing of a floating swan that appears against the backdrop of mountains, clouds, and a castle, does nothing to suggest the vodka comes from a different source.

黒色、灰色及び白色の黒ずんだ白鳥の描写は、主要な構成文字「BLACK SWAN」をより強く印象付ける効果をもたらす。他のデザイン要素は、白鳥の背景として機能するのみで、その印象を変えることも損なうこともほとんどない。ワインにおける商標権者の商標「BLACK SWAN」の文字のみを目にした需要者にとって、山々、雲、城を背景に浮かぶ白鳥の図柄の下に同じ文字を配置した商標は、ウォッカが別の出所であることを示唆するものではない。

文字と図形からなる商標について、文字部分が先行登録商標と同じ場合、図形部分をどう評価するのかが議論となります。本件では、図形中に描かれた暗い白鳥が文字部分の意味と重なることを根拠の一つとして、出所混同のおそれあり、と判断されました。この評価手法は、個人的に違和感があります。ここに描かれたのが白鳥ではなく、ホワイトタイガーであれば、結論は変わったのでしょうか？ワインにせよ、ウォッカにせよ、ラベルに、風景や動物・人物等が描かれることは一般に行われていますので、商標の類否判断において、図形部分と文字部分の関連性の有無は、あまり考慮すべきではないと思います。
