The earlier mark consists of the word ‘TOGGO’ represented in stylised, slightly displaced characters in orange. The stylisation, in spite of being rather fanciful, is of limited distinctiveness, as it will be perceived as essentially fulfilling a decorative purpose.
The word ‘TOGGO’ has no meaning for the Bulgarian-, Romanian- and Slovak-speaking parts of the EU public. Therefore, it is considered as a distinctive term. The applicant’ s arguments regarding the possible meaning of the term ‘TOGGO’ as the English verb ‘to go’ and or an expression in German, are unfounded. It can be assumed that at least a non- negligible part of the public, if not the majority, will not recognise any meaning in this word.

「TOGGO」の語は、EU域内のブルガリア語・ルーマニア語・スロバキア語圏の公衆の間では、何の意味も有さない。したがって、識別力を有する語と評価される。「TOGGO」の語からは、英語の動詞「to go」やドイツ語の表現の意味合いが生じ得るとの出願人の主張は、根拠を欠くものである。大多数でないにせよ、少なくとも無視できない数の一般公衆は、当該語から何の意味も認識しないことが推測される。

『「TOGGO」の語からは英語「to go」の意味合いが認識される』という主張。気持ちは分からなくはないですが、かなり苦しい感じがします。若い商標実務家・弁理士へのアドバイスとして、何か主張をする場合には、必ず根拠を挙げることが肝心です。最低でも１つ。弁理士であれば３つ。これを準備出来ているか否かが勝敗を決し、その人のスキル・実力、ひいては、クライアントの信頼につながります。商標実務家たるもの、日々、根拠の収集に明け暮れるべし。
