Of the remaining registered third-party marks shown below, we note that three of the registrations issued fourteen years ago or longer. While there is no evidence that the term “artificial intelligence” is new, the record indicates that the use of AI in software available to the general public is a more recent occurrence. In addition, we note the owner of the mark AI STORE is “Appraisal Institute.”
In short, we find the evidence of seven third-party registrations on the Principal Register for AI combined with presumptively descriptive matter does not rebut the evidence that the term AI is descriptive as applied to Applicant’s software.

要するに、主登録が認められた７件の第三者商標は、記述的と推定されるモノと「AI」の語との組み合わせに関することから、当該登録事実は、「AI」の語が出願人のソフトウェアとの関係において記述的であることを示す証拠を覆すものではない。

日本でも「AI」の語は、今や、「人工知能」を表す語として広く認識されるに至っています。ですが、「AI」が話題になる前は、「AI」は特段意味のない語でしかありませんでした（せいぜい、「愛」か？と思わせる程度）。米国で「MUSIC.AI」の識別力が争われた本件で、出願人は過去の登録例を挙げましたが、USPTOはそれをもって識別力の判断は覆らないとし、その根拠の一つとして、「14年以上前」の登録例であることを指摘しました。
『識別力の評価は時代とともに変わる』という識別力評価の大原則です。
