The element ‘noka’ or ‘nooka’ of the mark applied for will not be the only element to be pronounced. It must be held that the element ‘your space’, which is not devoid of distinctive character, will also be pronounced. That element therefore plays a role in the phonetic impression created by the mark applied for and distinguishes it from the earlier mark on account, in particular, of its impact on the length of that mark. In those circumstances, if the circular figurative elements of the mark applied for were pronounced like the letter ‘o’, the marks at issue would be phonetically similar to a below-average degree.

被異議商標は、「noka」又は「nooka」の構成要素のみが称呼を生ずるのではない。識別力を有する「your space」の文字要素も称呼を生ずる。したがって、当該文字は、被異議商標から生ずる称呼の印象に関与し、とりわけ、被異議商標の称呼全体に与える影響により、先行商標と区別させ得る。このような状況において、被異議商標の円形の図形要素が欧文字「o」のように発音された場合、被異議商標との称呼類似の程度は、平均以下といえる。
The marks at issue would be phonetically similar to a below-average degree.
類似性の程度が『平均以下』という場合、「below-average degree」が使われます。本件で、NOKIA社は「NOKIA」と「NOKA」又は「NOOKA」が紛らわしいとして異議を申し立てましたが、欧州一般裁判所は、「your space」の文字要素も勘案した上で、被異議商標の称呼を認定しました。「NOOKA」と「your space」の文字部分のフォントや大きさが異なりますので、この判断については、やや疑問を感じます。純粋に、「NOKIA」と「NOKA」、「NOOKA」を対比すれば足りるように思います。
