However, ‘OLYMPIC’ is aurally and visually almost identical to the Spanish word ‘olímpico’, meaning inter alia ‘belonging or relating to the Olympic games’, as mentioned in the contested decision, in the RAE Spanish Dictionary. As for the word ‘OLIMPRO’, this is likely to be split by a non-negligible part of the relevant public into the elements ‘PRO’, an abbreviation for ‘professional’ while ‘OLIM’ will be seen by that same portion of the relevant public as evocative of ‘OLIMPICO’, that is to say, belonging or relating to the Olympic games. Since neither of these meanings has any direct connection to the goods and services at issue, both verbal elements are considered to possess a normal degree of distinctiveness.

先行商標を構成する「OLYMPIC」の語と、被異議商標中の「OLIMPRO」の語に関して、いずれの語も、スペイン語で明確な意味を有さない。しかしながら、「OLYMPIC」は、異議決定において言及のとおり、RAEスペイン語辞典において、とりわけ、『オリンピック競技大会に属する、または関連する』を意味するスペイン語「olímpico」と、称呼及び外観においてほぼ同一である。「OLIMPRO」の語について、一方の「OLIM」の文字部分が、関連公衆の多くに、「OLIMPICO」、すなわち、『オリンピック競技大会に属する、または関連する』意味合いを想起させる語と認識されることから、「プロフェッショナル」の略語「PRO」と「OLIM」とに分離される可能性が高い。いずれの意味合いも、被異議商標に係る指定商品及び役務に直接関連するものではないため、両文字部分は、通常レベルの識別力を有するものと判断される。

４年に一度開催される世界的なスポーツの祭典「オリンピック」。日本でも「TOKYO2020」（コロナ禍の影響で、実際に開催されたのは2021年）が無観客の中、開催されました。
「オリンピック」に絡む商標のトラブル・紛争は数多くあり、それだけ、「オリンピック」商標の経済的価値が高いことの現れとも言えます。日本では、「五輪」という呼び方も使われていますが、この名称は、1936年のベルリン大会に、読売新聞運動部の川本信正記者が考案されました。オリンピック旗に世界の5大陸を表す5つの輪が描かれていること、「ゴリン」は「オリムピック」の冒頭の響きに似ていることから、宮本武蔵の「五輪書」もヒントに考案されたそうです。
