「threshold」（閾値）は、外国の判決・審決において比較的目にする語ですが、「threshold question」は、あまり見かけません。『始めに取り組むべき問題』を意味するようです。外国語を含む商標に対して、その言語のままで類似性を判断するのが適当か、それとも、日本語訳との類似性を評価すべきなのか、どちらかで結論も当然変わることから、『始めに検討すべき問題』であることに間違いありません。
