The greater or lesser degree of distinctiveness of the constituent elements of the signs at issue which are common to the earlier mark and to the mark applied for is one of the relevant factors in assessing the similarity of the signs at issue.
If the signs under comparison coincide only in elements with no, or in any event extremely weak, distinctive character, this circumstance would significantly reduce the relative weight of those elements in the overall comparison of the signs, including the visual and phonetic aspects, although their presence must still be taken into account.

対比する両商標が、識別力を全く有さないか、極めて弱い要素のみにおいて一致する場合、これらの要素も考慮に入れる必要はあるものの、当該事情は、外観上及び称呼上を含む両商標全体の対比において、当該要素の相対的な重要性を著しく低下させる。
