The examiner did not fail to consider the dot ‘.’ between the terms ‘MUSIC’ and ‘AI’. The examiner found that the dot simply reinforces that the sign is composed of two terms. The Board concurs with this finding.
The presence of the dot between the two words does not alter the meaning of the expression in question. Insofar as it is perceived at all, it would, at most, cause a short pause in speaking that emphasises the meaning of the subsequent word. The combination of these terms contains nothing that goes beyond the sum of their individual meanings.

審査官は、「「MUSIC」と「AI」の語の間に置かれたドット「.」を考慮しなかったわけではない。審査官は、ドットは、本願商標が２つの語で構成されていることを強調するに過ぎない記号と判断した。当審も、この判断に同意する。２つの語の間にドットが存在することで、当該表現の意味が変わるものではない。仮に、ドットと認識されたとしても、せいぜい、発音時に短い間合いを引き起こし、後に続く語の意味を強調する程度である。両語の結合は、各語の意味を合わせた以外の別の意味合いを有さない。

文字同士の結合商標の識別力の評価において、各構成文字から生ずる意味とは別に、全体として異なる意味合いが生ずるか否かというのは、実務上、非常に重要なポイントです。本件は、「MUSIC.AI」の識別力が議論となりました。日本でも、数年前までは「AI」は『人工知能の略称』との認識が定着していなかったため、「〇〇AI」（〇〇には識別力のない語が入る）は商標登録されましたが、今は、そういうわけにはいきません。
