As regards the meaning of the word element ‘nite’, it will naturally be associated by the English-speaking public with the word ‘night’ who will consider that the term ‘nite’ constitutes a deliberate or inadvertent misspelling of ‘night’. This conclusion is reinforced by the fact that, phonetically, the two words are pronounced identically in English.
A spelling error does not necessarily change the descriptive character of a sign. Words can be written incorrectly because of the influence of another language or because of a different spelling in a non-EU context, such as in the USA or slang. A word may also be intentionally altered in spelling to make it appear more commonplace or fashionable.

「NITE」は「NIGHT」のスペルミスと言えるか？これは、日本人の感覚では、中々判断しづらいように思われます。「HIGH」と「HI」であれば、見慣れていることもあり、「GH」が省略されたものと認識できますが、「NITE」と「NIGHT」では、３文字目以降のスペルが異なりますので、日本と欧州では判断が異なるように思います。このため、非日本語の商標については、日本で識別力が認められ商標登録できたからといって、海外でも同様に判断されるわけではない点、注意が必要です。
