日本でも、△、□、〇、◇といった、一般的に用いられる図形については、「極めて簡単で、かつ、ありふれた標章」に該当し、自他識別力を欠くとして、商標法第3条第1項第5号により、登録が拒絶されます。本件の場合、明らかに、通常の菱形とは異なる図形に見えますので、日本では、商標登録が認められる可能性の方が高いように思います。
