“Deceived” implies the creation of an incorrect belief or mental impression and causing “confusion” may go no further than perplexing or mixing up the minds of the purchasing public… Where the deception or confusion alleged is as to the source of the goods, deceived is equivalent to being misled into thinking that the goods bearing the applicant’s mark come from some other source and confused to being caused to wonder whether that might not be the case.
Although confusion is accepted to have a lower threshold than deception, being “caused to wonder” does not include mere “fleeting thoughts or associations.” The risk of deception or confusion must be real and tangible.

「誤認させる」とは、間違った考えや心象の形成を意味し、「混同」を生ずるとは、需要者の心を困惑させたり、混乱させたりする程度にとどまる場合もある。誤認や混同が商品の出所に関する本件の場合、「誤認させる」は、出願人の商標が付された商品の出所が別であると誤信させた状態を意味し、「混同」とは、出所が異なるのではと疑念を抱かさせた場合に生ずる。
混同の認定ハードルは、誤認より低いとされているが、「疑念を生じさせる」ことに、単なる「つかの間の考えや連想」は含まれない。誤認や混同のリスクは、現実的かつ具体的なものでなければならない。

日本では、「誤認混同」と一括りで捉える傾向が強いですが、海外では、誤認(deception)と混同(confusion)は、別々のものと処理されます。「deception(deceive)」の本来的な意味は『欺瞞。欺く』ですが、商標実務では、需要者を騙したかではなく、需要者の認識の程度として、「これはA社の製品だ」と完全に信じ切って誤解している状態(勘違いの度が過ぎて騙されているのと同等の状態)が『誤認』(deception)、「A社の製品か?関係あるのか?」と半信半疑な状態が『混同』(confusion)。
