Are LA & Design and LAV (Stylized) Confusable for Drinking Glasses?

The nature of stylized letter marks or composite marks with stylized lettering is that they are both visual and oral indicia, and we must weigh both in the context in which they occur.
A trademark that “consists of highly stylized letters … is therefore in the gray region between pure design marks which cannot be vocalized and word marks which are clearly intended to be.”
In this case, although the marks share the letters LA, the degree of stylization of LA in Applicant’s mark is so high that it more akin to a design mark rather than a stylized display of the letters LA.
Therefore, we find Applicant’s mark is not similar in sound, appearance, connotation or commercial impression to Opposer’s marks. The first DuPont factor strongly weighs in favor of a conclusion that confusion is unlikely.

図形付「LA」と図案化された「LAV」、コップ(食器)との関係で出所混同のおそれあり?

図案化された文字商標や図案化された文字を含む結合商標は、それらが視覚的且つ音声的な標識という性質を備えており、実際に使用されている状況を応じて、双方の性質を総合的に考慮しなければならない。
したがって、高度に図案化された文字からなる商標は、称呼が生じない純粋な図形商標と、明らかに発音されることを意図した文字商標との間のグレーゾーンに位置する。
本件において、両商標とも「LA」という文字を有しているものの、出願商標における「LA」の図案化の度合いが極めて高いため、「LA」という文字の図案化表示というより、むしろ、図形商標に近いものである。
したがって、出願商標と異議申立人の商標とは、称呼、外観、観念、商取引における印象のいずれにおいても非類似と判断する。デュポン・ファクターの1番目の判断要素は、出所混同が生じる可能性は低いという結論を強く支持するものである。
