To the extent that Applicant relies on its own particular use of the proposed mark with the first letter in the component terms capitalized—BalletCollective—this does not alter or obviate the generic meaning of the proposed mark. To the contrary, capitalizing the first letter of each word further assists consumers to more quickly identify each generic term. In any event, Applicant seeks registration of the mark, BALLETCOLLECTIVE, in standard character format, which means that it, if registered, Applicant will have protection and may use the mark in any font style, size or color, including in all capital or all lowercase letters. Thus, we cannot assume Applicant will always use the mark in that manner and it will be given rights to use the mark in all lowercase letters—“balletcollective”— as well as in all uppercase lettering.
