Acquired distinctiveness means that the “mark or dress has come through use to be uniquely associated with a specific source.”
Direct and circumstantial evidence may be considered, and we have approved analyzing the issue by considering six factors, without deeming all factors always relevant or the list exhaustive:
(1) association of the trade dress with a particular source by actual purchasers (typically measured by consumer surveys);
(2) length, degree, and exclusivity of use;
(3) amount and manner of advertising;
(4) amount of sales and number of customers;
(5) intentional copying; and
(6) unsolicited media coverage of the product [or service] embodying the mark.

使用による特別顕著性とは、「商標又はトレードドレスが、使用を通じて特定の出所と独自に結びつけられるようになった」ことを意味する。
直接証拠と間接証拠の両方が考慮され、特別顕著性の検討に際しては、以下の6つの要素を考慮することを認めているが、これら全てが常に関連し、また、当該リストが全てを網羅しているとも考えていない:
(1) 実際の購入者によるトレードドレスと特定の出所との関連性(通常は需要者調査により測定);
(2) 使用の期間、程度、および独占性;
(3) 広告の量および方法;
(4) 売上高および顧客数;
(5) 意図的な模倣;および
(6) 当該商標を付した商品・役務に関する、自発的なメディア報道。

length, degree, and exclusivity of use
商標の使用の程度に関する判断要素のうち、「exclusivity of use」というのは、商標を使っているのが出願人だけなのか、同業他社も使っているのか、を表しています。業界内で他社も広く使用していれば、需要者がその商標を見たとしても、特定の事業者の商品・役務を区別する目印とは認識し難いことから、「exclusivity of use 」(独占使用)か否かは、特別顕著性を裏付ける一つの評価指標と言えます。
