Indeed, in its common meaning, the term ‘pore’ means ‘a very small hole in the skin of people or other animals, or a similar hole on the surface of plants or rocks’. The relevant professionals will immediately recognise the term ‘pore’ in its common meaning when used in medical fields. Consequently, for the relevant professionals the term ‘pore’, commonly used in the medical field, will be of reduced distinctiveness, if any. Indeed, depending on the medical context of use, the term may indicate, for instance, the purpose of medical devices and tools that focus on cleaning, minimising the appearance of pores, and so improving overall skin health; to genetic analysis or treatments obtained or provided through cellular pores; etc.

「GENIAPORE」の語は全体として造語といえることから、通常は識別力を有する。しかし、本件で注視すべき関連分野の専門家は、被異議商標構成中の「PORE」の文字部分を分離して認識する可能性がある。現に、「pore」の語は、一般的な意味において、「人間やその他の動物の皮膚にある非常に小さな穴、あるいは植物や岩石の表面にある同様の穴」を意味する。本件に係る専門家であれば、医療分野で使用された場合、「pore」の語の一般的な意味を直ちに認識するだろう。その結果、当該専門家にとって、医療分野で一般的に使用される「pore」の語は、たとえ識別力があるとしても、その程度は低くなる。実際、医療現場での使用状況に応じて、当該語は、例えば、毛穴を洗浄し、その目立ちを最小限に抑え、ひいては肌の健康状態全体を改善することに目的とした医療機器や器具、あるいは細胞の毛穴を通じて行われる遺伝子解析や治療などを指す場合がある。
