For the German-speaking part of the relevant public, the word ‘CHRIST’ will be understood as meaning an individual who is a Christian, that is a follower of Christianity as a religion, whereas the word ‘CHRISTEN’ will be understood as the plural form of that same term, namely ‘Christians’. Neither meaning describes the kind, quality, intended purpose or any other characteristic of the jewellery, precious stones, timepieces and related goods at issue. Rather, the conflicting signs refer to a person (‘CHRIST’) or several persons (‘CHRISTEN’) who identify themselves or are identified as belonging to the Christian faith. This concept is not in any way descriptive of the goods concerned.
Accordingly, the verbal elements ‘CHRIST’ and ‘CHRISTEN’ are distinctive for the goods at issue.

公衆は、被異議商標から直ちにファッションデザイナーのニーナ・クリステンを想起しない
ドイツ語を話す関連公衆にとって、「CHRIST」の語は、キリスト教徒、すなわちキリスト教という宗教の一人の信者と理解されるのに対し、「CHRISTEN」の語は、その複数形、すなわち「キリスト教徒たち」と理解される。いずれの意味も、宝飾品、宝石、時計および関連商品の種類や品質、使用目的、その他の特徴を表すものではない。むしろ、両商標とも、キリスト教徒と名乗る、そのように捉えられている個人(CHRIST)または複数の人々(CHRISTEN)を指しており、当該意味合いは、決して、当該商品の内容を記述するものではない。
したがって、「CHRIST」及び「CHRISTEN」の文字は、当該商品との関係において自他識別力を有する。

商標の識別力は、指定商品・役務との関係で判断します。種類(kind)、品質(quality)、目的(intended purpose)、特徴(characteristic)等に該当するものは、日本でも、商標法3条1項3号により、自他識別力を欠く(=商標としての機能を発揮しない)として商標登録は認められません。上記以外にも、産地、販売地、原材料、効能、形状、生産方法、使用方法、時期、数量、価格を普通に用いられる方法により表示したものも、同号に該当します。
