In this instance, the earlier mark is made up of a stylised letter “Q”. Whilst, I do not consider this letter to have any relevance to the opponent’s services, I am also conscious that it is just one letter of the English alphabet, albeit it is a less commonly used letter in the alphabet, and single letter marks are typically regarded as being relatively low in inherent distinctiveness. Noting all of the above, I am of the view that the earlier mark, as far as the similar element is concerned (the letter “Q”), enjoys between a low and medium degree of distinctive character. I do not consider that the stylisation, which is minimal, increases the distinctiveness of the mark overall to any material extent.

外観及び称呼における両商標の類似性は、識別力を欠く観念の差異によって相殺 － ３
本件において、先行商標は図案化された「Q」の文字からなる。当該文字と異議申立人のサービスとの関連性が認められないものの、アルファベットの中ではあまり一般的に用いられない文字とはいえ、単なる英語のアルファベットの一文字に過ぎず、単一文字からなる商標は、通常、本来的識別力が比較的低いものとみなされることにも留意する必要がある。以上の点を踏まえ、類似する要素、「Q」の文字に関して言えば、先行商標の識別力の程度は、低～中の間にある。軽微な図案化によって、先行商標全体の識別力が実質的に高まるとは認められない。

日本でも、欧文字一文字からなる商標は、「極めて簡単で、かつ、ありふれた標章」に該当するとして、商標法第３条第１項第５号により、図案化されていない限り、商標登録は認められません。その観点から捉えると、本件異議申立におけるUKIPOの判断は極めて妥当と言えます。
