Although the signs contain the same letters, the earlier mark introduces a structural break by means of the full stop placed before the final letter ‘P’. This punctuation mark separates the element ‘PO’ from the final letter and creates a segmented peculiar structure which differs from the single word applied for which is of reduced distinctiveness in relation to the goods at issue. In this regard, the mere presence of the same letters in both signs cannot be sufficient to conclude that there is a degree of visual similarity.
Moreover, the shorter a sign, the more easily the public is able to perceive all of its single elements. Therefore, in short words, small differences may frequently lead to a different overall impression.

両商標には同じ文字が含まれているものの、先行商標は最後の文字「P」の前にピリオドを置く構成において、変化している。この句読点は、最後の文字と「ＰＯ」の文字要素とを分離することで、一部が分割された独特の構造を生み出しており、指定商品との関係において識別力が低い本願商標の単一の語とは異なる。この点において、両商標が同じ文字から構成される事実のみをもって、外観類似を認めるに十分と判断することはできない。
さらに、商標が短ければ短いほど、公衆は、当該商標の構成要素一つ一つをすべて容易に認識できる。したがって、文字数が少ない語の場合、わずかな相違であっても、商標全体の印象の違いにつながることが多い。
