In the present case, the earlier mark is a word mark, consisting of the letters ‘PO’ followed by an additional letter ‘P’ separated by a dot. Regarding the structure of the sign, due to the dot between the sequence ‘PO’ and the letter ‘P’, the sign clearly consists of two separate elements. While it is true that the dot is a punctuation mark, and as such it has little trade mark relevance, the fact remains that the uncommon structure of the sign clearly prompts the perception of the sign as consisting of two separate units. The relevant public may perceive these letters as an abbreviation, initials or an acronym, or simply as an invented sequence of letters of unusual structure with no specific meaning.

本件において、先行商標は、「PO」の文字の後に、ドットを挟んで「P」の文字が付加された構成の文字商標である。構造に関して、「PO」の文字列と「P」の文字の間にドットがあるため、当該商標は明らかに2つの別個の要素からなる。ドットが句読点であることに間違いなく、その点において、商標との関連性は低いが、当該商標の珍しい構成により、当該商標は2つの別個のユニットからなるものと認識させることは明らかである。関連公衆は、当該文字をみて、略語、頭文字、または頭字語、あるいは、単に、特定の意味を有さない、変わった構成の文字の並びと認識する。

Eメールやインターネットを頻繁に使うようになった現在では、ドット「．」は、日本でも日常生活にまで浸透しています。昔は、「点」の方が一般的だったと思いますが、読み方がガラッと変わってしまった事例の一つといえます。商標においては、ドット「．」が前後の文字を分離するのか、それとも結合するのかが議論になります。本件の場合、構成文字は全て同じで、中間のドットのみ相違という事案でした。「POP」の欧文字が意味を有し、馴染みあることが結論に影響したものと思われます。
